General terms and conditions

We wish to hint at the General Business Terms of the DeHoGa.

Legal situation when booking a hotel room:

• If a hotel room is booked, confirmed or provided on a short-term basis, a so-called Gastaufnahmevertrag (contract of taking guests) comes into existence.

• The conclusion of such a contract obliges the contractual partners to fulfil the mutual obligations throughout the whole length of the contract.

• The innkeeper is obliged to keep the room available according to the reservation.

• The guest if obliged to pay the room charge and fees for the length of stay.

• In case that a guest does not make us of the hotel room that he ordered, he is nevertheless legally obliged to pay the charge for the arranged hotel service. The reason for the hindrance does not matter at all. Thereby only actual savings of the establishment have to be set.

• Based on experience, the savings of the establishment amount to 20% of the arranged charge.

• In case that the innkeeper can farm out the room that has not been taken, the guest’s obligation to pay the amount for revenues that could have been attained elsewhere during this period will be omitted.

• The innkeper is entitled to a cash payment of all services before departure and thus has a legal right of lien on the guest’s belongings.

• The place of jurisdication is the hotel’s location as even if the room will not be taken, the services out of the Gastaufnahmevertrag (contract of taking guests) will have to be performed at the location.
